COURSE DESCRIPTION

The course will examine the history and emerging and growing body of law relating to the Internet along with the challenges and opportunities of representing internet startups.  The sources of Internet law are many, from intellectual property to tort to privacy law. Given the newness and complexity of this technology, special attention will be paid to the application of existing laws and models to cyberspace and how technology is challenging settled legal understandings. Class discussions will consider, among other issues and policy discussion, practical approaches to current problems and the business issues faced by clients.

It should be useful for law students, law firm and in-house lawyers in companies thinking of dealing in internet commerce or international B2B or B2C sales, as well as for IP lawyers and litigators. Internet entrepreneurs looking for a legal background are also welcome. Prior courses in IP law helpful, but not required.

Over the sessions the professor intends to cover (possibly not in this order)

I.         IDEAS AND THEIR PROTECTION: What is Public and What is the Public Domain? 

II.        DOMAIN NAMES:  Ownership, Control, and Protection (in the US, in the EU, and Elsewhere)

III.       TRADEMARKS:  Creation, Registration, Policing and Enforcement (Generally and Against Domain Squatting)

IV.       COPYRIGHT: Creation, Registration, Enforcement & "Fair Use" (Generally and Under Free Speech Principles)

V.        DATA COLLECTION AND PRIVACY:  U.S. & E.U. Regulations and Waivers Under Written "E-Agreements" 

VI.       ELECTRONIC CONTRACTS: E-Signature Laws in the U.S., in the E.U. and Internationally

VII.      SPAM, ADVERTISING AND SPYWARE

VIII.     BUSINESS AND COMMERCE ON THE INTERNET 

IX.        INTERNET CRIMES: UNAUTHORIZED INTRUSIONS ON COMPUTER SYSTEM
